Protection of persons who report unlawful conduct

In accordance with Directive (EU) 2019/1937 of the European Parliament and of the Council of 23 October 2019 on the protection of persons who report breaches of Union law and with Act No. 171/2023 on the protection of whistleblowers, the University of Hradec Králové has implemented a system for reporting notifications.

Options for submitting reports:

  1. The ideal way to submit a report is through the secure application FaceUp, where you can do so anonymously. After clicking the link, select "My organization" and the access code: "whistleblowing."  

  2. It is also possible to submit in person at the UHK Registrar office or in writing to:

  3. Or by telephone at the phone numbers of the relevant persons.  
  4. In person, by arrangement with the relevant person.  
  5. If you want to reach out outside of UHK, the ideal way is through external communication with the Ministry of Justice.

Your notification will be handled by the so-called relevant person  

There are two relevant persons at the University of Hradec Králové:

The relevant person is the only one authorized to access the reports and thus assess them. Both relevant persons confirmed this commitment in writing and are legally bound by the whistleblower protection law.

Relevant person:

  • Will receive your report.
  • Investigates the report and, if it is found to be justified, will propose measures to the university management to remedy or prevent unlawful conduct.
  • Maintains confidentiality regarding you and the content of the report.
  • Keeps in contact with you throughout and informs you about the status of the resolution of the report and any measures taken.

Whistleblower

Whistleblowers can be employees or former employees, employed under an employment contract (short-term, full-time), members of UHK bodies, advisory bodies, and working committees, individuals who have performed or are performing internships, training, or volunteer work at the university. The University of Hradec Králové also accepts reports from job applicants. Further information in the directive.  

Reports target unlawful acts that:

  1. have characteristics of a criminal offense,
  2. have characteristics of an offense for which the law sets a fine rate, the upper limit of which is at least 100,000 CZK,
  3. violate the law concerning the protection of whistleblowers, or
  4. violate another legal regulation or regulation of the European Union (see more in the directive).

Content of a report

In your report, specify what happened or what is threatening to happen, who committed the unlawful act, when and where it occurred, how it occurred, what means were used, why it occurred/what the motive was, and what damage is threatened or has occurred in connection with such conduct. Also, define the position from which you're reporting (e.g., I am an employee, I am a job applicant, etc.). 

Reports processing

  • The relevant person must inform the whistleblower within 7 days of the receipt of the report.
  • You will be informed about the outcome of the review within 30 days. The period may be extended twice by 30 days.
  • If the report is found to be justified, the relevant person must propose measures to prevent or remedy the unlawful conduct. You will also be informed about this.
  • The report will be archived for 5 years. Reports are stored in a secure environment, the FaceUp app.

Protection of Whistleblowers

The essence of the EU directive and the law on the protection of whistleblowers is to protect persons who report unlawful conduct. Hence protection is guaranteed at UHK so that the identities or contents of the reports are not disclosed to third parties.
