Provision of Information at the UHK

The provision of information about the University of Hradec Králové (hereinafter referred to as “UHK”) is governed by Act No. 106/1999 Coll., On Free Access to Information (hereinafter referred to as “the Act”). Pursuant to Section 5 (1) of the Act, the UHK publishes the following information in order to inform the public:

Reason and Method of Establishing UHK

The University of Hradec Králové is a public university pursuant to Act No. 111/1998 Coll., on Universities and on Amendments and Supplements to Other Acts (the Higher Education Act), as amended, carrying out all types of study programmes and in connection with this scientific and research, development, artistic or other creative activity.

It builds on its legal predecessors in its activities. In 1959, the Pedagogical Institute in Hradec Králové was established as a university by Government Decree No. 57/1959 Coll. In 1964, an independent Faculty of Education was established in Hradec Králové by merging the pedagogical institutes in Hradec Králové and Pardubice, and it was renamed to the University of Education in Hradec Králové on the basis of the Act of the Czech National Council No. 375/1992 Coll. UHK obtained its current name in 2000 on the basis of Act No. 210/2000 Coll.

Place and Way to Get Relevant Information

An application for information is submitted orally, by telephone or through the network or electronic communications service and it is directed directly to UHK employees according to their function classification. If possible, these employees are obliged to provide the requested information by return, or to refer the applicant to the already published information.

If the applicant is not provided with information on such application, or if the applicant does not consider this information to be sufficient, the application must be submitted in writing.

Written submissions of employees, students and citizens are accepted by the UHK Rector’s Office either in writing at Rokitanského 62, 500 03 Hradec Králové or by e-mail via the electronic Registrar at epodatelna@uhk.cz. The application in writing can also be delivered to the Registrar of the UHK Rector’s Office personally.

  1. Processing of written applications for providing information

(1) If the lack of information about the applicant (name, surname or identification number of the artificial person, address of the applicant for correspondence, or in case of a request sent by e-mail, a sender's functional e-mail address) hinders the application process, the applicant will be within 7 days of the date of submission of the application, invited to complete the application; if the applicant fails to comply with this invitation within 30 days of its receipt, the application shall be suspended.

(2) If the application is incomprehensible, it is not clear what information is required or it is formulated too generally, the applicant will be asked within seven days of the submission of the application to specify the application; if the applicant fails to specify the application within 30 days from the date of receipt of the invitation, a decision to reject the application shall be issued.

(3) If the requested information does not relate to the competence of the University of Hradec Králové, the application shall be suspended and this justified fact shall be communicated to the applicant within 7 days from the date of delivery of the application.

(4) In the absence of a decision pursuant to the foregoing points, the information shall be provided in accordance with the application within no more than 15 days from the date of receipt of the application or from the date of its completion; where a licence is required, the final licence offer shall be submitted to the applicant within that period. In the case of serious reasons, this period may be extended, but no more than by 10 days.

  1. Refusal Decision

(1) If the application, even if only partially, cannot be satisfied, a decision to reject the application or to reject a part of the application shall be issued within the time limit for processing the application, except where the application is suspended.

(2) If the application has not been satisfied for reasons of the protection of business secrets or the protection of the rights of third parties to the subject of copyright, the reasoning of the decision shall indicate who exercises the right to such business secrets or who exercises the property rights to this subject of copyright protection, if the person is known.

  1. Appeal

(1) An appeal may be lodged against the decision to reject the application. The appeal is submitted in the same way as a written application for providing information (see above).

(2) The Rector shall decide on the appeal within 15 days.

(3) A negative decision cannot be appealed; it is, however, reviewable by a court.

  1. Complaint

(1) A complaint about the procedure for processing the application for providing information may be lodged by the applicant,

    1. Who disagrees with handling the application,
    2. To whom no information or no final licence offer has been submitted after the deadline and no decision to reject the application has been issued,
    3. To whom the information was provided in part without a refusal decision being made on the remainder of the application.

(2) Complaints may be made in writing or orally; if the complaint is made orally and it cannot be settled immediately, a written record shall be made.

(3) A complaint shall be submitted in the same way as a written application for providing information (see above), and precisely within 30 days from

    1. The delivery of the notification pursuant to s. 6, s. 14 (5) (c) or s. 17 (3) of the Act,
    2. The expiry of the deadline for providing information pursuant to s. 14 (5) (d) or s. 14 (7) of the Act.

(4) The Rector shall decide on the complaint within 15 days from the day, on which it was submitted to him.

The costs incurred by the University from a third party in relation to the provision of information shall be charged to the applicant in full. Postage according to the valid price list for postal services will be charged for sending the information to the address given by the applicant. All prices are exclusive of VAT.

The provision of information that is subject to copyright protection will be proceeded in full compliance with s. 14a of the Act.

Resolution of the Superior Body on the Amount of Payments Issued pursuant to s. 16a (7) of the Act

The Rector is the superior body for reviewing the procedure for handling complaints about the procedure for dealing with the application for providing information and he will decide on the amount of payment or remuneration within the meaning of the cited statutory provision.
